Minister’s Rules Amended to Broaden ACCS Scope

Last week the Hon Jason Clare MP, Minister for Education, made the Child Care Subsidy Amendment (Additional Child Care Subsidy) Minister’s Rules 2023 which amends the Child Care Subsidy Minister’s Rules 2017 to prescribe additional circumstances in which Additional Child Care Subsidy (child wellbeing) certificates or determinations may be backdated for a longer period (up to 13 weeks, instead of up to 28 days).

The additional circumstances have been added to section 11A of the Minister’s Rules and are as follows:

  • The child is in a formal foster care arrangement (within the meaning of section 8E of the Rules);
  • The eligible individual, their partner or the child is homeless; and
  • The eligible individual, their partner or the child is affected by the harmful use of alcohol or another drug.

The Amendment Rules will commence on 16 October 2023.

Be Audit Ready!

As members are aware, the Australian Government Department of Education (‘the Department’) is now auditing service providers to ensure compliance with the new EFT gap fee payment requirement, as well as other obligations under Family Assistance Law (FAL).

FDCA has developed a ‘Be Audit Ready’ fact sheet to help our members demonstrate compliance with the new requirements. The fact sheet can be downloaded here. Key topics covered in this factsheet are:

  • Audit Process and Documentation Requirements – understand what the Department will review during an audit.
  • Reasonable Steps – learn about what the Department means by ‘all reasonable steps’.
  • Good Practice Strategies – explore effective oversight processes to maintain compliance, accurate record keeping, clear communication with families and ongoing support to educators.

The Department has also developed some helpful online guidance to assist providers in understanding how to comply. We urge all services to carefully read this guidance.

The development of our ‘Be Audit Ready’ factsheet forms part of the EFT Transition resource suite which we developed with funding from the Australian Government to support services in complying with the new EFT gap fee requirement and ensuring adequate oversight of gap fee collection.

The Emerging and Perpetual Star Awards recognise educators, coordinators and services that are new to the sector or role and those who have shown dedication over several years.

The Emerging Star Award

The Emerging Star Award celebrates an educator, coordinator and service that is new to the family day care sector or their role and has made a big impact in a short amount of time. The Emerging Star Award is presented to an educator, coordinator and service that commenced their role/business in the past two years.

The Perpetual Star Award

The Perpetual Star Award honours an educator, coordinator and service that have contributed to the family day care sector for a significant period of time and continues to thrive. The Perpetual Star Award is presented to an educator, coordinator and service that has worked in the family day care sector for more than 15 years.

The winners of the Star Awards represent the talent of emerging educators, coordinators and services and the wisdom of those who continue to give to the sector.
