Changes to Regulatory Requirements for Family Day Care Services from 1 July 2023

Another round of regulatory changes flowing from the 2019 Review of the National Quality Framework (NQF) come into effect soon.

Changes to family day care educator minimum qualifications

New family day care educators, registered from 1 July 2023 must hold an approved Certificate III qualification (or higher) to provide education and care. ‘Actively working towards’ a qualification will no longer be acceptable.

Existing educators have until 1 July 2024 to complete an approved Certificate III qualification.

Staffing waivers may still be available, you can apply for a waiver through NQAITS.

Read ACECQA’s information sheet on legislative requirements for family day care providers from 1 July 2023 here.

Changes to family day care coordinator to educator ratios

At present the ratio of family day care coordinator to educators is 1 coordinator to 25 educators (for most services that have been operating for more than 12 months). From 1 July 2023, providers can employ a pro-rata (part-time) coordinator as a second/subsequent coordinator to monitor and support the additional educators.

For example, if there are 30 educators, the provider must employ or engage:

  • A full-time equivalent (FTE) coordinator; and
  • A second coordinator for 0.2 of an FTE (ie. the equivalent of one full day per week).

The family day care coordinator to educator ratio for services that have been operating for up to 12 months is 1 coordinator to 15 educators and is not affected by this change.

Changes to the definition of Persons with Management or Control (PMC)

From 1 July 2023 the definition of PMC will be expanded to ensure that regulatory authorities can assess the suitability of all persons that have influence, control or authority over the delivery of the approved provider’s services.

The definition of PMC will include any person who has:

  • Authority, responsibility or significant influence over the planning, direction, or control of the activities of the service, or the delivery of the service.

Under the new definition, PMCs will include persons both within and outside the approved provider entity. In addition to persons who hold executive or management role, PMCs will also include:

  • Persons without a formal role in the approved provider entity;
  • Volunteers; and
  • Persons employed by third-party management companies.

Approved providers should:

  • Check the PMCs they have currently notified in NQAITS; and
  • Notify the Regulatory Authority of any additional PMCs that meet the new definition by 15 July 2023 using forms PA08 and PA02 through NQAITS.

Educational Leader Facebook Support Group - Callout for Moderators

As the national peak body of family day care in Australia, we recognise the vital role educational leaders play in the family day care space and understand the importance of quality leadership in the sector.

To assist educational leaders in connecting and sharing insights, we are creating a private Facebook support group for FDCA members.

As part of this process, we are calling for expressions of interest from educational leaders who would like to volunteer as group moderators, monitoring discussion within the group and ensuring group rules are upheld.
